Agreement
These Terms of Service ("Terms") govern your use of Caption Caddie, the native macOS application and related services offered at captioncaddie.app. Caption Caddie is a product of Second Crop Creative, LLC, a Wisconsin limited liability company ("Caption Caddie," "we," "us," or "our"). By downloading, installing, activating, or using Caption Caddie, you agree to these Terms. If you do not agree, do not use the app.

The service
Caption Caddie is a desktop application for macOS that helps sports and editorial photographers generate and apply image captions using AI-assisted workflows. The app runs on your Mac. Your photos, rosters, and project data are stored locally unless you choose to send images to a third-party AI provider (see below). Caption Caddie is not a cloud storage or backup service.
- macOS only. Caption Caddie requires macOS 15 or later.
- Bring your own AI key. Cloud captioning requires your own Google Gemini API key. You pay Google directly for API usage.
- Your review. AI-generated captions are assistive. You are responsible for reviewing and approving captions before wire transmission, FTP, or publication.
Beta program
From time to time we offer a free beta for invited testers. Beta access is provided at no charge for approximately 90 days for testing and feedback. Beta terms are separate from the paid subscription and free trial described below.
- Beta builds may change, break, or be withdrawn without notice.
- We may ask for feedback; participation helps improve the product but is not guaranteed to continue access.
- Beta is provided "as is" without warranties or service-level commitments.
- When the beta ends, continued use may require a paid subscription.
Subscriptions and pricing
After the beta period, Caption Caddie is offered as a paid subscription. Current pricing is $11.99 per month, subject to change with notice before your next renewal.
Payments, subscriptions, trials, tax receipts, and refunds are processed by Lemon Squeezy, our merchant of record. When you purchase or subscribe, you are also subject to Lemon Squeezy's buyer terms. Lemon Squeezy appears on your payment statement and handles sales tax where applicable.
Free trial
New paid subscribers may receive a 7-day free trial with full access to the app. The trial is separate from the invite-only beta program.
- A payment method is collected at signup through Lemon Squeezy checkout.
- Cancel before the trial ends to avoid being charged.
- If you do not cancel, you will be charged $11.99 when the trial ends, then monthly until you cancel.
- One free trial per customer unless we explicitly authorize otherwise.

License and device activations
Paid and beta access is licensed, not sold. Your license key is emailed after purchase or beta signup. You may activate Caption Caddie on a limited number of Macs per license, as shown in the app and set in your Lemon Squeezy license.
- Each activation uses one device slot on your license.
- You can deactivate a Mac from within the app (Settings) to free a slot for another machine.
- If you cannot access a previously activated Mac, contact support@captioncaddie.app for help resetting activations.
- You may not share, resell, or publish license keys except as we expressly allow.
Your responsibilities
- Provide accurate account and billing information through Lemon Squeezy.
- Keep your license key confidential.
- Use Caption Caddie only for lawful purposes and only on images you have the right to process.
- Do not reverse engineer, circumvent license checks, or abuse the service.
- Maintain your own Gemini API key and comply with Google's terms.
Third-party services
- Lemon Squeezy — billing, subscriptions, license keys, and customer portal.
- Google Gemini — optional cloud AI; governed by Google's terms and your API account.
- Photo Mechanic — optional workflow integration; not required but commonly used with Caption Caddie.
We are not responsible for third-party outages, pricing changes, or policy changes.
Acceptable use
You may not use Caption Caddie to violate any law, infringe intellectual property, harass others, distribute malware, or overload our or our providers' systems. We may suspend or revoke access for violations or abuse.
Disclaimers
Caption Caddie is provided "as is" and "as available." We do not guarantee uninterrupted operation, error-free captions, or fitness for a particular assignment. AI output may be inaccurate or incomplete. You are solely responsible for captions you transmit or publish.
To the fullest extent permitted by law, we disclaim all warranties, express or implied, including merchantability and fitness for a particular purpose.
Limitation of liability
To the fullest extent permitted by law, Caption Caddie and its operators will not be liable for any indirect, incidental, special, consequential, or punitive damages, or for lost profits, data, or goodwill, arising from your use of the app. Our total liability for any claim related to the service is limited to the amount you paid us for Caption Caddie in the twelve (12) months before the claim, or fifty US dollars ($50) if you have not paid anything, whichever is greater.
Changes and termination
We may update these Terms from time to time. We will post the revised Terms on this page and update the "Last updated" date. Material changes may also be communicated by email or in-app notice where appropriate. Continued use after changes constitutes acceptance.
You may stop using Caption Caddie at any time. Subscription cancellation follows our Refund Policy. We may terminate or suspend access for breach of these Terms or non-payment.
Governing law
These Terms are governed by the laws of the United States and the State of Wisconsin, without regard to conflict-of-law principles. Any dispute will be resolved in the state or federal courts located in Wisconsin, and you consent to their jurisdiction.
